U.S. Says It Won't Take Part in Lawsuit Against Medco ; Pharmacy Benefit Company Accused of Fraud

FRANKLIN LAKES - Medco Health Solutions Inc., the largest U.S. provider of pharmacy-benefit services, said the government declined to join a "whistle-blower" lawsuit claiming that the company defrauded health plans for federal employees.

The U.S. Justice Department notified the U.S. District Court for the Eastern District of Pennsylvania that it will not intervene in the suit, which repeated allegations that Assistant U.S. Attorney James Sheehan in Philadelphia cited in a 2003 complaint, Medco said in a Securities and Exchange Commission filing Wednesday.
